ARTICLES OF ASSOCIATION OF MOHAMMADIYA EDUCATION SOCIETY, GUNTUR

1. Name : Mohammadiya Education Society, Guntur

2. Address : 3d Line, Pothurivarithota, Guntur

3. Constitution :
Constitution of Mahamadiya Education Society, Guntur under the provisions of its Bye-law which shall consist of Memorandum of Association as Part I and the Articles of Association as Part II.

4. Source of Income :
Collection fee from the students, collection of receipts on movable and immovable properties, collection of subscriptions and charities from the Public and grants from the Government.

5. Way of Expenditure :
Expenditure shall be incurred to fulfill the aims and objectives of the Organisation.

6. Membership :
There shall be five types of Membership as shown below :
(a) Founder Member
(b) General Member
(c) Honorary Member
(d) Life Member
(e) Institutional Member

(a) Founder Membership :
Founder members are those who had founded this Mahamadiya Education Society and got the same registered under the Societies Registration Act XXI of 1860 to run the Andhra Muslim College and its other institutions under the provisions of minorities provided in the Indian Constitution.

b) General Membership :
Any Muslim who attains majority and offers to enroll himself or herself as general number of the Society and undertakes to abide by the bye-law of the Organisation is eligible for admission as General Member on payment of Rs. 1000/- towards Membership fee. The Membership shall be made renewal for every five years otherwise the Membership will be ceased.

c) Honorary Members :
The Officials of the Government, VIPs and well-wishers of the Organisation shall be co-opted by the Executive Committee to give advices for better administration of the College and other Institutions.

d) Life Members :
Any person who attains majority offers himself or herself to be enrolled as member and undertakes to abide by the bye-laws of the Organisation, is eligible for admission as Life Member on payment of Rs. 1,00,000/- towards his or her membership fee. The Life member shall be the Member in Executive Committee for his life time.

(e) Institutional Membership :
Any Muslim Institution having the same aims and objects of this Organisation (or) engaged in similar type of work of this Organisation and offers collaboration with the working of this Organisation and shall abide by the bye-laws of this Organisation is eligible for admission as Institutional Member on payment of Rs. 1,000/- towards Membership fee :

7. Admission :
Every member said in Article (b), (c), (d) and (e) offers himself or herself to enroll shall be sponsored by a member of this organization. The Executive Committee has to approve the admission and it shall be entitled to reject any request for membership without assigning any reason.

8.CHIEF ORGANS OF THE ORGANISATION :
(a) General Body
(b) Executive Committee

(a) GENERAL BODY :

i) The General Body consisting of all the members that is said in Article 8 (a), (b), (d) (e).
ii) General Body shall meet at least once a year.
iii) The General Body Meeting shall conduct by giving Notice to its members 15 days in advance.
iv) The General Body Meeting shall be conducted by its President and in his absence the Vice-President shall conduct the meeting. If both of them are absent the attending Executive Committee Members shall elect any of them to preside the meeting.
v) The quorum for the General Body Meeting shall be 1/4 or 50 members whichever is less to conduct the General Body Meeting.
vi) The Resolution of the Meeting shall be passed on the majority votes of the members present to the Meeting.
vii)The General Body shall elect the Executive Committee for every five years.
viii)The Annual General Budget and Accounts of the Organisation which are approved by the Executive Committee shall be presented in the General Body Meeting. By Secretary of the Organisation.

(b) EXECUTIVE COMMITTEE :

i) The Executive Committee shall consist of 15 members who are the members of the General Body and shall be elected by the General Body to the Executive Committee. The Life members of the Organisation shall be the additional members of the Executive Committee.

The Honourary Members of the Organisation shall be Ex-Officio Members to the Executive Committee and its not have vote to elect the Office-bearers of the Organisation.

ii) The Executive Committee shall consist of President, Vice-President, Secretary, Joint Secretary, Organising Secretary and Correspondent as Office Bearers and (9) nine members of the Executive Committee.
iii) The Office Bearers of the Organisation that is, President, Vice-President, Secretary, Joint Secretary, Organising Secretary and Correspondent shall be elected by the Executive Committee for every five years.
iv) The tenure of the Office of the Executive Committee shall be five academic years.
v) The Executive Committee shall execute policies inference of the aims and objects of the Organisation and it takes final decision on every policy matter.

The Executive Committee shall appoint the employees of the College and other Institutions which are under control of the Organisation. The Executive Committee shall appoint the sub-committees for specific purpose.
The Executive Committee shall approve the annual accounts and Budgets of the College and other institutions.
vi) The Executive Committee shall meet ordinarily at least once in a month with 7 days notice, and the urgent meeting shall be convened with 24 hours notice.
vii) The quorum for the Executive Committee shall be 1/3 rd of the total members The President shall preside over the meeting of the Executive Committee in his absence the Vice-President shall preside over the some. If both of them are absent any member of the Executive Committee, who will be elected by the Executive Members, who are present at the time of meeting, shall conduct the meeting.

The Executive Committee members who are not present for three consecutive monthly meetings without intimation on valid reasons, his / her memberships shall be ceased. The Executive Committee shall have powers to condone the ceased membership of a member at his request subject to the satisfaction of the grounds mentioned in it.

In case of default in payment of membership dues, his or her name shall be deemed to have been removed from the Membership list.

9. OFFICE BEARERS OF THE ORGANISATION :
(i) PRESIDENT :

(a) The President shall conduct the General Body and Executive Committee meetings.
(b) The President shall be Executive Head of the Organisation.
(c) The President shall inspect accounts of the Organisation and its institutions.

(ii) VICE-PRESIDENT :

The Vice-President shall act as President in the absence of President and shall assist the President in promoting the programme of the Organisation.
(iii) SECRETARY :

(a) The Secretary shall be the Executive Head of the Office of the Organisation
(b) The Secretary shall prepare the accounts and budgets and shall take the approval of the Executive Committee
(c) The Secretary shall use and to be used on behalf of the Organisation and he shall enter into contracts on behalf of the Organisation.
(d) The Secretary shall collect rents, donations or contributions from the public for the organization and pass on an official receipt.
(e) The Secretary shall prepare the Voters List of General Body to conduct the election of the Executive Committee in a secret manner for every five years. The panel system shall be adopted for election of E.C. Members. The casual vacancies of the B.C. shall be filled up by the Executive Committee members in election when vacancies arises.

iv) JOINT SECRETARY :
The Joint Secretary shall act as the Secretary in the absence of the Secretary and shall assist the Secretary in promoting the programmes of the Organisation.

(v) ORGANISING SECRETARY :
The Organising Secretary shall organize to establish the Social, cultural and academic institutions attached to the College. He shall organize all social and cultural programmes to be conducted by the college and its other Organisation.

(vi) CORRESPONDENT :
The Correspondent shall be incharge of the Andhra Muslim College and he shall have power to supervise all the staff of the college.
He shall prepare the annual accounts and budget and submit to the Secretary of the Organisation for the approval of the Executive Committee.
He shall correspondent with Government and the University Grants Commissions to get affiliation and the University Grants.

10. FUNDS OF THE ORGANISATION :
(a) The funds of the Organisation shall be deposited in a Nationalised Bank in Guntur chosen by the Executive Committee of the Organisation.
(b) The funds shall be deposited in Joint Accounts under the operation of the President and Secretary of the Organisation.
(c) The Society shall have powers to acquire and dispose of movable properties and immovable properties of the society for the benefit of the Institution
(d) The funds of the Andhra Muslim College shall be deposited in the Nationalised bank in Guntur chosen by the Executive Committee of the Organisation, in joint account under the operation of the President and Correspondent.

11. AMENDMENT OF THE BYE-LAWS :
Any amendment to the bye-laws may be initiated at the Executive Committee meeting by a resolution signed by Five members, a notice in writing of their intention to move such resolution with a copy of the proposed amendment, has been sent three weeks before the meeting to the Secretary of the Organisation.

A Change in the bye-laws shall not be valid unless it is adopted by the 2/3 rd majority of the members present at the meeting of the Executive Committee specially called for the purpose and it is confirmed by 2/3 rd majority of the members present at second special meeting.

12. WIND-UP OF THE ORGANISATION :
In case of the Society has to be wound-up property and funds of the Society will remain after full satisfaction of liabilities of the society will be transferred or paid to some other institution with similar aims and objects.
